1 Scope and contracting party
(1) These terms apply to every ride booked with RIED.TAXI – via the website ried.taxi, WhatsApp, our chat assistant RiTa, the ChatGPT app, by phone or by e-mail.
(2) Your contracting party is: Etwas Anders by Franz Stelzhamerhof e.U., Kirchenplatz 4, 4920 Schildorn, Austria, company register FN 412356g, VAT ATU68513316, phone +43 7754 8009, e-mail [email protected] (“we”).
(3) Deviating terms of the customer only apply if we expressly agree to them in writing.
(4) Mandatory consumer rights, in particular under the Austrian Consumer Protection Act (KSchG), remain unaffected.
2 Booking and conclusion of contract
(1) An enquiry or a reservation is not yet a binding commitment. The contract is concluded only when we expressly confirm the ride (confirmation with a booking number by WhatsApp, e-mail or in writing).
(2) A reservation number issued by our assistant RiTa holds the ride for you. It becomes binding with our personal confirmation; the number stays the same.
(3) The customer is responsible for complete and correct details: date, pick-up time, exact pick-up and destination address, flight number for airport pick-ups, number of passengers, luggage, child seats and special luggage (e.g. skis, bicycles, wheelchair). Additional costs or the impossibility of the ride caused by incorrect or incomplete details are borne by the customer.
(4) Anyone who books a ride for another person (e.g. an office, a company or a hotel) is liable for payment alongside the passenger, unless agreed otherwise.
3 Prices and services
(1) Our prices are fixed prices per vehicle, not per person. They include road tolls and vignette, airport parking, flight monitoring for airport pick-ups and the waiting time set out in section 5.
(2) Not included, and only possible if agreed in advance: intermediate stops, detours, changes of pick-up or destination address, additional waiting time and special luggage. These are charged reasonably according to effort; additional waiting time at EUR 10 per started 15 minutes.
(3) One vehicle carries a maximum of five passengers. With five passengers there is room for five large suitcases or eight carry-on trolleys. For additional luggage, a luggage box on the tow hitch (280 litres, payload up to 50 kg) can be added for EUR 40 per booking up to 24 hours before pick-up; it covers the outbound and return journey of the same booking. Luggage beyond this and special luggage are only carried by prior arrangement. We may refuse luggage that exceeds what was booked and cannot be stowed safely; the ride itself is not affected.
(4) All prices are in euros and include statutory VAT.
4 Payment
(1) The fare is due after the ride and is paid in cash or by card.
(2) Payment by invoice is only available to businesses that have registered with us once, and must be agreed when booking. Invoices are payable within 7 days without deduction.
5 Pick-up, waiting time and journey time
(1) We will be at the agreed pick-up point at the agreed time.
(2) For airport pick-ups we monitor the flight. The pick-up follows the actual landing time. 60 minutes of waiting time from landing are included in the price. After landing, the driver contacts the passengers by WhatsApp or phone and picks them up right outside the terminal’s arrivals exit. A meet-and-greet with a name sign in the arrivals hall is available on request and must be asked for when booking.
(3) For all other pick-ups, 15 minutes of waiting time from the agreed pick-up time are included in the price.
(4) On the day of the ride the passenger can be reached at the phone number given when booking.
(5) Journey times are estimates. Delays caused by circumstances beyond our control – such as traffic jams, accidents of third parties, weather, road closures, diversions or border checks – do not give rise to claims. For departures we agree the pick-up time together, with a sufficient time buffer.
6 Cancellation by the customer and no-show
(1) A confirmed ride can be cancelled free of charge at any time, as long as our vehicle has not yet set off for the pick-up.
(2) If our vehicle is already on its way to the pick-up point, we only charge the approach already driven: EUR 0.75 per kilometre for the distance driven and the way back, at most the agreed fare. Example: the pick-up is agreed at Munich Airport and the cancellation reaches us near Salzburg – we only charge the distance to Salzburg and back, not the whole ride.
(3) If our vehicle is at the pick-up point at the agreed time and the ride is cancelled there, or if the passenger does not appear after the waiting time in section 5 and cannot be reached by phone, the full fare is due.
(4) If a flight is cancelled or diverted, please tell us immediately. Paragraphs 1 to 3 apply accordingly. We are happy to take on a new date if our schedule allows.
(5) We do not charge flat fees, only the actual, reasonable costs incurred. The customer is free to prove that our costs were lower.
7 If we cannot carry out a confirmed ride
(1) A confirmed ride is a commitment for us. We never cancel a confirmed ride voluntarily or lightly, and we do everything we can to honour every confirmed booking.
(2) Nevertheless, in rare cases we may be unable to start or complete a ride for reasons beyond our reasonable control. These include in particular: a sudden technical defect or an accident of the vehicle, a sudden illness or accident of the driver, severe weather, snow and ice, flooding, road and border closures, orders by the authorities, strikes, pandemics and comparable events of force majeure.
(3) In such a case we inform the customer as quickly as possible using the contact details given when booking.
(4) We always look for a solution that is fair to both sides. Where possible, we arrange a partner company or point out another way to travel. A partner company drives in its own name and at its own prices, which may differ from the agreed fixed price. We state the price in advance where we know it; the customer is free to accept the offer or not. There is no entitlement to replacement transport.
(5) We charge nothing for a ride we do not carry out. Amounts already paid are refunded in full.
(6) Any further claims – in particular for the additional cost of another taxi or means of transport, missed flights or connections, additional overnight stays or loss of earnings – are excluded. This does not apply where we caused the failure intentionally or through gross negligence, nor to personal injury (section 9).
8 Breakdown or interruption during the ride
(1) The safety of our passengers always comes first.
(2) If a ride has to be interrupted because of a breakdown, an accident or any other reason under section 7 (2), we immediately help to organise the onward journey – for example a partner taxi, public transport or roadside assistance. The cost of the onward journey is borne by the passenger.
(3) For the interrupted ride we charge no fare.
(4) Further claims are excluded as set out in section 7 (6).
9 Liability and insurance
(1) Our vehicle carries liability insurance for commercial passenger transport, plus passenger accident insurance. Statutory liability for road accidents is not affected by these terms.
(2) We are liable for personal injury in accordance with the law.
(3) For any other damage we are only liable in case of intent or gross negligence.
(4) Towards businesses, our liability for other damage is – as far as legally permitted – additionally limited to the amount of the agreed fare.
(5) Passengers are responsible for their luggage and belongings. Cash, valuables, documents and medication belong in the hand luggage, not in the boot.
10 Conduct in the vehicle
(1) Seat belts must be worn. Smoking, including e-cigarettes, is not permitted.
(2) Children are only carried with a legally required child seat. Please request child seats when booking.
(3) Animals are carried by prior arrangement.
(4) If the vehicle is soiled beyond the usual extent, we charge the actual cleaning costs. Damage to the vehicle is the liability of whoever caused it, in accordance with the law.
(5) We may refuse or end a ride if safety is at risk, in particular in case of aggressive behaviour or heavy intoxication.
11 Lost property
We keep items found in the vehicle for 30 days. On request we send them at the owner's cost and risk; after that we hand them to the competent lost-property office.
12 Data protection
We process personal data in accordance with our privacy policy at ried.taxi/en/privacy. If we arrange a partner company under section 7 or 8, we only pass on the data needed for the ride (name, phone number, pick-up and destination address, time).
13 Final provisions
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers this applies only insofar as it does not deprive them of mandatory protection under the law of their country of habitual residence.
(2) The place of jurisdiction for businesses is Ried im Innkreis. For consumers the statutory places of jurisdiction apply.
(3) These terms exist in German and English. In case of discrepancies the German version prevails.
(4) Should any provision be invalid, the remaining provisions remain in force.
